Terms of Service

2ndLook — youth sports video coaching marketplace

1. Agreement and eligibility

These Terms govern your use of 2ndLook's website, accounts, messaging, video tools, and payment features (the “Platform”). By creating an account, accepting an order, uploading content, or otherwise using the Platform, you agree to these Terms and acknowledge the Privacy Policy. If you use the Platform for a minor, you represent that you are the minor's parent or legal guardian, have authority to agree on the minor's behalf, and accept responsibility for the minor's use.

Coaches must be at least 18 years old. Parents must provide accurate age and date-of-birth information; under-13 children may participate only through a parent-managed account after verifiable parental consent, and 13–17-year-olds only with a parent's permission and active supervision.

2. The service

2ndLook is a marketplace and communications service. Athletes (or their parents) browse coach profiles, select a service tier, submit sports-performance videos and questions, and receive video or written feedback from the coach. Unless stated otherwise, the independent coaches — not 2ndLook — provide the coaching services. We do not employ coaches, direct their professional judgment, guarantee their availability, or promise any athletic result.

Tier 1 includes one athlete submission and one coach video response. Tier 2 includes the initial submission plus up to three coach-response rounds, each of which may follow one athlete follow-up. Listing details (price, response time, limits) form part of each order.

Coach profiles marked “Sponsored” or “Promoted” reflect paid placement, not an endorsement or guarantee of quality.

3. Payments and refunds

Prices are displayed before purchase. The purchaser authorizes 2ndLook and its payment processor to charge the total shown at checkout, including applicable taxes and disclosed fees. Payment processing is provided by a third-party processor under that provider's terms; we do not store full payment-card credentials. Users may not move an introduced coaching transaction off-platform to evade fees.

A purchaser may cancel for a full refund before the coach begins substantive work. Once work begins, refunds follow the listing terms, applicable law, or our approval — for example when a coach misses the delivery deadline or materially violates these Terms. Multi-critique packages (such as a three-exchange package) are sold as a bundle: if you use fewer than the included critiques by your own choice, the unused portion is not prorated or refunded. However, if a coach fails to deliver all exchanges in a multi-critique package, you may request a proportional refund for the undelivered exchanges through support. Report order problems and request refunds through support within 30 days after completion or the missed deadline. Contact support before initiating a payment chargeback.

4. User conduct and safety

All communications with or about a minor must be professional, coaching-related, and conducted through the Platform with parent visibility. The following are prohibited: requesting or sharing a minor's personal contact information, address, schedule, or location; moving a minor conversation to another channel; asking a minor to hide communications; sexual content or grooming; harassment, threats, or bullying; arranging in-person meetings without express parental involvement; and recording, copying, or redistributing athlete content beyond what the order requires.

We may use automated tools and trained reviewers to screen content for safety risks. We may preserve and disclose content when reasonably necessary to protect a child, comply with law, or enforce these Terms, and may report suspected exploitation to law enforcement or the National Center for Missing & Exploited Children.

Remote video feedback is educational information, not medical diagnosis or a guarantee of performance. Athletes should use safe equipment and locations, stop if they experience pain or concerning symptoms, and keep adult supervision while filming.

5. Minors and parental consent

We comply with the Children's Online Privacy Protection Act (COPPA) where it applies. A child under 13 may not independently create an account; participation requires a parent-managed account, direct notice to the parent, and verifiable parental consent before personal information is collected. Parents may review or delete the child's information, withdraw consent, and stop further collection at any time. Under-13 profiles are not publicly displayed and receive no targeted advertising.

Parents using the Platform for a minor agree to supervise the minor's use and review coach communications, keep login credentials under adult control, ensure safe filming conditions, and report concerns promptly.

6. User content and improvement data

You retain ownership of the videos, messages, and other content you upload (“User Content”). By uploading User Content, you grant 2ndLook a worldwide, non-exclusive, royalty-free license to host, display, transmit, and reproduce it as needed to operate the Platform and fulfill orders.

We may also use de-identified and aggregated User Content — including videos, coach annotations, drawings, and feedback notes with all personal identifiers removed — to improve our services, develop coaching tools, and train machine-learning models (for example, automated form-analysis features). De-identified data cannot reasonably be linked back to you or your child. We will never sell your personal information or use identifiable videos of minors for advertising or model training without separate, explicit consent.

If you do not want your de-identified content used for service improvement and model training, you may opt out at any time through account settings or by contacting support. Opting out does not affect data already de-identified and incorporated into aggregated datasets or trained models.

7. Enforcement and termination

We may investigate suspected violations and may warn, restrict, suspend, or terminate users when reasonably necessary to protect users, prevent fraud or harm, comply with law, or enforce these Terms. We may act without advance notice in urgent safety, exploitation, fraud, or security situations. You may close your account through account settings or support, subject to pending orders, payouts, disputes, safety holds, and lawful retention. Payment obligations, content licenses for records, intellectual-property provisions, disclaimers, liability limits, indemnity, and dispute terms survive termination.

8. Disclaimers and limitation of liability

The Platform is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties and do not warrant uninterrupted operation, that every user is who they claim to be, that moderation will detect every violation, or that a coach's advice will be safe or effective for a particular athlete.

To the fullest extent permitted by law, 2ndLook and its officers, directors, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for the acts, omissions, advice, or content of coaches or other users. Total aggregate liability will not exceed the greater of the amount the claimant paid to 2ndLook in the 12 months before the event giving rise to the claim, or $100. These Terms are governed by Minnesota law, without regard to conflict-of-law rules.

9. Changes and contact

We may update these Terms prospectively and will provide reasonable notice of material changes through the Platform, email, or another appropriate method. Continued use after the effective date constitutes acceptance where permitted by law. Support and legal contact details will be completed before publication.
